Terms of Use for PARAVOX Applications

Welcome to PARAVOX, developed by EION Development, LLC ("we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our PARAVOX ghost hunting applications, including any related software, services, or content (collectively, the "Application"). By downloading, installing, accessing, or using the Application, you agree to be bound by these Terms. If you do not agree, please do not use the Application.

1. Purpose and Disclaimer

PARAVOX is designed to support paranormal research and investigation, offering tools to assist users in exploring and documenting potential paranormal activity. However, EION Development, LLC makes no guarantees about the accuracy, reliability, or validity of the Application’s features, readings, or outputs. All results are provided for informational purposes only and should not be considered definitive evidence of paranormal activity. We are not liable for any damages, losses, or consequences arising from your use of the Application, including any reliance on its outputs or actions taken based on its results.

2. Eligibility

You must be at least 13 years of age to use the Application. By using the Application, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you must have the consent of a parent or legal guardian to use the Application.

3. License to Use the Application

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes. You may not:

• Modify, reverse-engineer, decompile, or disassemble the Application.

• Copy, distribute, or create derivative works based on the Application.

• Use the Application for any commercial purpose without our prior written consent.

• Remove or alter any copyright, trademark, or other proprietary notices in the Application.

4. User Conduct

You agree to use the Application responsibly and in compliance with all applicable laws. You will not:

• Use the Application to harass, harm, or intimidate others.

• Attempt to gain unauthorized access to the Application or its systems.

• Use the Application in a way that infringes on the intellectual property or privacy rights of others.

• Introduce viruses, malware, or other harmful code to the Application.

5. Intellectual Property

All content, features, and functionality of the Application, including but not limited to software, designs, text, graphics, and trademarks, are owned by EION Development, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. PARAVOX is a trademark of EION Development, LLC. You may not use our trademarks or other intellectual property without our prior written permission.

6. Privacy

Your use of the Application is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Application, you consent to our data practices as described in the Privacy Policy.

7. No Warranties

The Application is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Application will be error-free, uninterrupted, or compatible with your device. You use the Application at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, EION Development, LLC, its affiliates, officers, directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Application, including but not limited to damages for loss of profits, data, or other intangible losses. This limitation applies even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless EION Development, LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Application, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the Application at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your license to use the Application will cease, and you must uninstall the Application from your device. Sections 5, 7, 8, 9, and 11–13 will survive termination.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms in the Application or on our website at least 30 days before the changes take effect. Your continued use of the Application after the effective date constitutes your acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Application will be resolved through binding arbitration in Conway, South Carolina, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.
